Planning Appeal: Crossgates, Fife
PPCA was engaged to advise a housebuilder following refusal of planning permission by local authority members against the advice of officers.
The project involved the preparation, submission and administration of the appeal and subsequent documentation exchanges.
PPCA was also involved in:
- the instruction of Counsel
- administering the requirements of other consultants involved in the appeal (architectural, civil and traffic engineering)
- the provision of landscape evidence in the course of the Inquiry.
One of the principal issues related to the validity of using indicative numbers of houses allocated to the appeal site, as indicated in the adopted Local Plan, and other policies on housing density endorsed by the local authority in their Finalised Structure Plan.
It was successfully argued that the detailed proposals were compatible with the site in terms of house numbers, traffic, environmental and visual impact and that the appeal should be upheld.
The appeal was upheld following discussions to resolve S.75 Agreements to regularise financial matters.
